D’Empaire has represented and advised international and Venezuelan clients in arbitrations under several rules systems and arbitral institutions, including the International Chamber of Commerce (ICC), the American Arbitration Association (AAA), the International Centre for Settlement of Investment Disputes (ICSID), the Caracas Chamber of Commerce and CEDCA. We have advised and represented many clients in arbitration proceedings, including:

• a major international manufacturer of hot briquetted iron (HBI) in an ICSID arbitration against the Government of Venezuela

• a major Mexican cement manufacturer in an ICSID arbitration against the Government of Venezuela arising out of the nationalization of the largest cement company in Venezuela

• a Chinese oil & gas company in an ICC arbitration against a Nigerian contractor arising out of obligations under an oil rigs joint venture agreement

• a Canadian energy company in a dispute with a Venezuelan state-owned company over the supply of orimulsion fuel under the AAA rules

• a consortium led by an international engineering, procurement and construction company in four ICC arbitration proceedings against a joint venture company among the Venezuelan state-owned oil company and two major oil & gas companies arising out of the force majeure clauses and labor disputes under an EPC contract for the construction of a heavy oil plant in Venezuela

• the Venezuelan largest steel producer in an arbitration under the Caracas Chamber of Commerce rules against the Venezuelan state-owned gas company arising out of the most favored nation clause under a gas supply contract

• a major Italian telecom operator in an ICC arbitration against certain minority shareholders of its Venezuelan mobile phone subsidiary arising out of its obligations under a shareholders’ agreement

• a German provider of industrial services in a dispute against a Venezuelan state-owned chemical company arising out of an EPC contract

• a major Mexican cement manufacturer in an ICC arbitration against a leading French cement producer

• a Colombian supermarket chain in an arbitration proceeding under the Caracas Chamber of Commerce rules against a Venezuelan competitor

• a Venezuelan TV network in a WIPO arbitration proceeding

• a Venezuelan leading food company in an arbitration under the Venezuelan Arbitration Law rules arising out of certain representations under a stock purchase agreement
